Missouri Court of Appeals

The Missouri Court of Appeals has three divisions throughout the state of Missouri. It is the intermediate appellate court for the state divided into the Eastern District, Western District, and Southern District.  Cases settled in the Missouri Court of Appeals are then taken to the Supreme Court of Missouri for further appeal if the losing party chooses to not accept the result.  Often times, however, the Supreme Court of Missouri may reject appeals from the Missouri Court of Appeals.  The decision to do so is called discretionary jurisdiction.  Thus, because of this, the decision made by the Missouri Court of Appeals is most likely the final decision.

Jurisdiction of the Missouri Court of Appeals

Jurisdiction for all appeals that are not handled by the Supreme Court of Missouri through exclusive jurisdiction is handled by the Missouri Court of Appeals.  The exclusive jurisdiction of the Supreme Court of Missouri is exercised on cases referring to the validity of a United States statute or treaty, the validity of a Missouri statute or constitutional provision, the state’s revenue laws, challenges to a statewide elected officials right to hold office and imposition of the death penalty.

Appeals that fall under this five categories of exclusive jurisdiction are handled by the Supreme Court of Missouri, not the Missouri Court of Appeals.

When hearing an appeal, the Missouri Court of Appeals considers and evaluates all briefs, oral arguments, transcripts, pleadings and exhibits from the trial before making any decision or writing its opinions.  All decisions are made based on the Constitution and laws, not on personal preference or opinion from the judge.  After a decision is made and finalized, the court’s opinions are opened for public view and appear on the official website of the Missouri Court of Appeals.

Districts of the Missouri Court of Appeals

The Missouri Court of Appeals is divided into three districts based on geographical location: Eastern District, Western District and Southern District.  Appeals from trials in St. Louis County are heard by the judge in the Eastern District with appeals from trials in Jackson County (Kansas City) are heard by a judge in the Western District.

The Eastern District location is in the historic Old Post Office building in downtown St. Louis at One Post Office Square, 815 Olive Street, Room 304, St. Louis, Missouri 63101.

The Western District is located in downtown Kansas City at 1300 Oak Street, Kansas City, Missouri 64106-2970.

The Southern District is located in Springfield, Missouri at 300 Hammons Parkway, Springfield, Missouri 65806.
